If we accept your loan application, we will pay Your Marketing Fees to Your Property Agent on your behalf. However, no loan or contract comes into force until such time as your payment of the first instalment is received by us. You may draw down on any balance available up to the above credit limit, but only to meet additional property marketing fees incurred during the marketing campaign for the above property being sold. You agree that the following terms and conditions will apply if your application to pay Your Marketing Fees in instalments is accepted: 1 If the property being marketed is sold, all remaining amounts to be paid under this contract and any fees which are unpaid become immediately due and payable at settlement. You hereby irrevocably authorize the same to be deducted from proceeds due to you at settlement and to be paid to us. 2 Time is of the essence of your payment obligations. If you fail to make any payment on time, you will be charged interest on anything outstanding until it is paid at the default rate of 6.5% per annum. We may also send you a notice of default, and stating that we may cancel this contract. If the payment remains unpaid for more than 7 days after that notice is given to you, we may cancel this contract without further notice to you. You then become liable to immediately pay us all payment instalments and interest and fees remaining unpaid, plus a cancellation fee of $40. Also, if you fail to pay all your payments by the time they all should have been paid, you will be charged an administration fee of $10 each month (or part of a month) until you have paid all of your payments, and also you have paid any other interest, fees or charges payable under this contract. 3 Any dispute between you and Your Property Agent, or any deficiency or delay in any services provided to you by Your Property Agent, does not modify or release your obligation to pay all instalments strictly on time. 4 We may charge a text/email/letter fee of $15 if you default in payment, and we then write to you to require payment and/or warn that we intend to cancel this contract. 5 We may charge a reprocessing fee of $30 if we need to reprocess a payment due to a payment default by you. 6 If you breach this contract, and we take action to enforce our rights, you must pay us back any reasonable enforcement expenses we incur. 7 To the extent you decide to make payments under this contract by direct debit, you confirm that you are authorised to operate on the account/s nominated, and you request and authorise Easybondpay Pty Ltd trading as easyAdpay (User ID 510331) to debit an account nominated with amounts to be paid under this contract. This debit or charge will be made through the Bulk Electronic Clearing System (BECS) from your account held at the financial institution nominated, and will be subject to the terms and conditions of the Direct Debit Request Service Agreement at https://easyAdpay.com.au/DDRSA. 8 To the extent you decide to make payments under this contract by credit card, you acknowledge that the following credit card fees will be added to the amount debited: Visa 2.43%, Mastercard 2.50%, Amex 1.57%. We may vary these fees pursuant to law, provided the new fees are within the limits permitted by law. Details of fees applying from time to time are at https://easyAdpay.com.au/cardfees. 9 You authorise us to debit your bank account or credit card nominated with any shortfall in payment or remaining amount owing by you, or any other fee or amount due and owing by you to us under this contract. Also, notwithstanding any request of yours as to which specific bank account or credit card account that payments are to be debited to, you authorise us to debit any outstanding amounts to any account for which you have provided details to us 10 You agree to keep us informed of any changes to your contact, bank or credit card details to enable us to administer this contract and to collect amounts payable under it. 11 In the loan application process, and in collecting payments or taking other action under this contract or when required by law to verify your identity, we will collect, use, store and disclose your personal information. You agree to us doing so, provided we do so in accordance with our Privacy Statement and Policy, which you can access at https://easyAdpay.com.au/privacy. That link also includes information about credit reporting, including the credit reporting bodies to which we are likely to disclose your credit information, as well as how we manage credit related personal information. Key matters covered are your rights to access and correct that information, and to make a complaint. If you ask us, we will provide you with this website information in an alternative form, such as a hard copy. 12 You consent to any notice or information being given to you by us by way of electronic communication as defined in the various Electronic Transactions Acts or Electronic Communications Acts of the States, Territories and the Commonwealth. Further, both we, and you, also consent to the following method to identify you and signify your request in terms of this document (so as to constitute your signature to this document under the Electronic Transactions Acts or Electronic Communications Acts and also under direct debit rules): the insertion of your name in the relevant space provided above, and the posting, faxing, emailing or on-line transmission of this document to us by you, Your Property Agent, or any person acting on your behalf. 13 (a) If there is more than one of you, each of you is jointly and severally liable to perform each of your obligations under this contract. (b) We may assign, transfer or novate our obligations, rights or interest in our arrangements with you without your consent. (c) This contract is personal to you, and you must not assign, transfer or novate your obligations, rights or interest under this contract without our prior written consent. (d) We may pay commission to persons who introduce your business to us. (e) You acknowledge that Your Property Agent, and its officers, employees and representatives, are not agents of ours and have no authority to bind us or to act on our behalf. 14 The law of South Australia applies to this contract. Any legal action relating to it must be brought in South Australian courts.
