CLAUSE18 (1)CONDITIONSOFSALEBYAUCTION
(Property,StockandBusinessAgentsAct2002andRegulation2003)
The followingconditionsareprescribedasapplicable toand in respectof the
salebyauctionof landor livestock:
(a) Theprincipal’s reservepricemustbegiven inwriting to theauctioneer
before theauctioncommences
(b) Abid for the sellercannotbemadeunless theauctioneerhas,before the
commencementof theauction,announcedclearlyandprecisely the
numberof thebids thatmaybemadebyoronbehalfof the seller.
(c) Thehighestbidder is thepurchaser, subject toany reserveprice.
(d)
In theeventofadisputedbid, theauctioneer is the solearbitratorand the
auctioneer’sdecision isfinal.
(e) Theauctioneermay refuse toacceptanybid that, in theauctioneer’s
opinion, isnot in thebest interestsof the seller.
(f) Abidder is taken tobeaprincipalunless,beforebidding, thebidderhas
given to theauctioneeracopyofawri enauthority tobid fororon
behalfofanotherperson.
(g) Abidcannotbemadeoracceptedafter the fallof thehammer.
(h) As soonaspracticableafter the fallof thehammer thepurchaser is to
sign theagreement (ifany) for sale.
CLAUSE18 (2)CONDITIONSOFSALEBYAUCTION
The followingconditions, inaddition to theabove,areprescribedasapplicable
toand in respectof the salebyauctionof residentialpropertyor rural land:
(a) Allbiddersmustbe registered in theBiddersRecordanddisplayan
identifyingnumberwhenmakingabid.
(b) Onebidonlymaybemadebyoronbehalfof the seller.This includesa
bidmadeby theauctioneeronbehalfof the seller.
(c) Whenmakingabidonbehalfof the selleroracceptingabidmadeby
oronbehalfof the seller, theauctioneermustclearly state that thebid
wasmadebyoronbehalfof the sellerorauctioneer.
WARNINGS
CLAUSE20 (1)PENALTYFORCOLLUSIVEPRACTICES
It isanoffenceagainst theProperty,StockandBusinessAgentsAct2002 for
aperson todoanyof the followingasa resultofacollusivepractice,or to
induceora empt to induceanotherpersonbyacollusivepractice todoanyof
the following:
(a) toabstain frombiddinggenerally,or
(b) tobid toa limitedextentonly,or
(c)
todoanyotheractor thing thatmightprevent freeandopencompetition.
Severepenaltiesmaybe imposedonpersonsconvictedofcollusivepractices.
CLAUSE20 (2)SUCCESSFULBIDDERS
Theactual successfulbidderatanauction salemustgive to theauctioneeror
employeeof theauctioneer:
(a) thebiddersname,or
(b) thenameof thepersononwhosebehalf the successfulbidwasmade
